The Russian president signed the Federal Law On amendments to the Federal law On the Russian Highways State Company and to individual laws of the Russian Federation and Article 31 of the Federal Law On the coming into force of the Land Code of the Russian Federation.
The federal law was adopted by the State Duma on July 9, 2010 and approved by the Federation Council on July 14, 2010.
Background to the federal law provided by the state-legal department
The federal law aims at ensuring efficient organization of operations of the Russian Highways State Company. With this aim it specifies individual provisions of the Federal law On the Russian Highways State Company and amendments to several laws of the Russian Federation.
In particular, it specifies the powers of the state company as a grantor in concession agreements and the rules and order of provision (reservation) of land plots for operations of the state company, and allows transferring all non-invested funds remaining on the account of the state company in the Federal Treasury to the next fiscal year.
The federal law determines the powers of the governing bodies of the state company in securities issue and placement.
The federal law determines that project documents for highways in trust management by the state company, sections of such highways and roads to be built and reconstructed by the state company, as well as results of engineering research for preparations of the mentioned project documents shall be transferred to the state company by the federal body of authority in charge of state services provision and state property management in road industry by a deed of transfer and acceptance.
Besides, to streamline the transfer of land plots to the state company the federal law stipulates that land plots in the right-of-way of the state company highways shall be leased to the state company upon its application for the provision of the land plots submitted to the federal body of executive authority in charge of state services provision and state property management in the road industry.
The federal law also amended the Federal law On the coming into force of the Land Code of the Russian Federation.
